Sort and edit databases
With the consent to the processing of data from the customer, data is collected, recorded and collected by which entrepreneurs create a database of personal data. Entrepreneurs who have not maintained such databases or information systems to manage such data will experience considerable problems in the context of the GDPR.
What are databases?
The GDPR information system defines a database as any organized set of personal data that is accessible according to certain criteria, regardless of whether it is centralized, decentralized or distributed on a functional or geographical basis.
How can the problem occur
Most entrepreneurs focused mainly on creating large databases of contacts and personal data with limited usability. In doing so, they used personal data to a greater extent than the legal title based on the business relationship defined. It was processing of data beyond the legitimate interest. The GDPR stipulates that when processing personal data, it must be agreed to what data, for what purpose and to what extent they will be processed. The data subject must be clearly informed that he has the right to withdraw his consent at any time. The GDPR stipulates that consent should also be informative.
Sort your databases
On the part of processors, it is important to sort and modify the databases of personal data processed and to discard contacts that were obtained other than with the direct consent of the data subject. If the data are processed with the consent of the data subject, the controller should be able to prove that the data subject has expressed his consent. The processor may not use personal data unless the data subject has given his or her consent.
The GDPR obliges entrepreneurs or personal data controllers to implement technical and organizational measures. AIFMs must be able to demonstrate that their processing is in accordance with GDPR.
